Terms of Service

1. Agreement to Terms

By accessing or using CraftBoop ("the Service"), operated by CraftBoop ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and CraftBoop.

2. Description of Service

CraftBoop is an automated email follow-up platform for local service businesses. The Service enables you to add customer contacts after completing a service job and automatically sends a sequence of personalized follow-up emails over a 60-day period. These emails include thank-you messages, review requests, check-ins, re-booking reminders, and referral requests. Email templates are generated using artificial intelligence and are fully editable by you.

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Service, you represent that you have the authority to bind your business to these Terms. The Service is intended for use by legitimate service businesses operating in the United States.

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary. You must notify us immediately of any unauthorized use of your account.

5. Free Trial and Subscription

5.1 Free Trial

New accounts receive a 14-day free trial with full access to all features. A valid payment method is required to start the trial. You will not be charged during the trial period. If you cancel before the trial ends, you will not be charged.

5.2 Subscription Plans

After the trial period, your subscription will automatically convert to a paid plan at the rate you selected during sign-up:

  • Monthly plan: $19 per month, billed monthly.
  • Annual plan: $190 per year (equivalent to $15.83/month), billed annually.

All plans include unlimited customers, all five email sequence steps, AI-generated templates, CSV bulk upload, full analytics, and referral tracking.

5.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually) at the then-current rate, unless you cancel before the renewal date. We will send you a reminder email before each renewal. You authorize us to charge your payment method on file for each renewal period.

5.4 Cancellation

You may cancel your subscription at any time through your account settings page or by contacting us at support@craftboop.com. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the period you have already paid for. No refunds are provided for partial billing periods.

5.5 Price Changes

We may change subscription prices with at least 30 days' written notice. Price changes will take effect at the start of your next billing period after the notice. If you do not agree to the new price, you may cancel before the next billing period.

6. Your Responsibilities

By using the Service, you agree that:

  • Legitimate customer data only: You will only upload contact information for individuals who are actual customers of your business and who have a prior business relationship with you. You will not upload purchased email lists, scraped contacts, or information of individuals who have not done business with you.
  • Authority to send emails: You have the legal right and authority to send commercial emails to the contacts you upload, in compliance with the CAN-SPAM Act and all applicable state laws.
  • Accurate business information: You will provide your accurate, current business name and physical mailing address. This information is included in every email sent on your behalf as required by the CAN-SPAM Act.
  • No review manipulation: You will not use the Service to manipulate, fabricate, or artificially inflate reviews. You will not offer incentives conditioned on customers leaving positive reviews. You will not use the Service to selectively solicit reviews only from customers expected to leave positive feedback (review gating).
  • No fake reviews: You will not use AI-generated content or any other means to create fake reviews. The AI features in CraftBoop generate email templates only — never review content.
  • Compliance with review platform policies: You are responsible for complying with the terms of service and policies of Google, Yelp, and any other review platform you direct customers to.
  • Respect unsubscribes: You will not re-add customers who have unsubscribed from your email sequences.
  • Lawful use: You will use the Service only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations.

7. Email Compliance

Emails sent through CraftBoop comply with the CAN-SPAM Act and applicable state email laws:

  • Every email includes your business's physical mailing address.
  • Every email includes a one-click unsubscribe link that is honored immediately.
  • Subject lines accurately reflect the content of the email.
  • Emails include List-Unsubscribe headers for email client compatibility.
  • Unsubscribe requests are processed immediately and are permanent for that customer-business relationship.

You are responsible for ensuring that the emails sent on your behalf contain accurate information about your business. We are not liable for inaccurate business information you provide.

8. AI-Generated Content

CraftBoop uses artificial intelligence to generate email template suggestions based on your business type and information. You acknowledge that:

  • AI-generated templates are suggestions and should be reviewed and edited by you before use.
  • You are ultimately responsible for the content of all emails sent through the Service, including AI-generated content you choose to use.
  • AI is used solely for generating email templates — never for creating review content on behalf of consumers.
  • We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content.

9. Intellectual Property

The Service, including its design, features, code, and branding, is owned by CraftBoop and protected by copyright, trademark, and other intellectual property laws. You retain ownership of the content you upload (customer data, customized templates). You grant us a limited license to use your content solely to provide the Service to you.

10. Prohibited Uses

You may not:

  • Use the Service to send unsolicited bulk email (spam) or to contacts without a prior business relationship.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to harass, abuse, or harm others.
  • Interfere with or disrupt the Service or its infrastructure.
  • Resell, sublicense, or provide the Service to third parties without our written consent.
  • Use automated tools to scrape, crawl, or extract data from the Service.
  • Violate any applicable law or third-party rights through your use of the Service.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm us, our users, or third parties. We will provide reasonable notice before termination except in cases of serious violations. Upon termination, your right to use the Service ceases immediately, and any pending email sequences will be stopped. You may request a copy of your data within 30 days of termination.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING ANY SPECIFIC NUMBER OF REVIEWS, CUSTOMERS, OR BUSINESS OUTCOMES.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRAFTBOOP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless CraftBoop, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including the rights of your customers; (d) the content of emails sent through the Service on your behalf; or (e) any claim that your use of the Service caused damage to a third party.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with the arbitration conducted in the state of the defending party. Each party shall bear its own costs. YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes are effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
